    I thought Judge Martin did an excellent job during proceedings, and his decision and summation were spot on. I agree completely with bringing in an independent Judge and prosecution given Raineys position.

    What I disagree with is said independent prosecution launching an appeal with a couple of hours to go before a 21 day deadline, after the independent judge (Martin) has described the police investigation as:
    “ranging from inappropriate to reprehensible”.
    This is a waste of money and resources. The only people who will benefit are NSW silks getting WA public money in their pocket. The timing of the appeal lodgment shows just how much faith they have in the appeal, its a desperate gambit, just like the prosecution itself. Somebody should have the fortitude to say "NO", because this is grasping at straws, there is no serious transgression in Judge Martins decision.

    IMO the independent prosecution failed from the get go, they SHOULD have said before the trial there is no case, we will not prosecute.

    It is difficult to conceive that the trial judge could have made so many 'errors of law'.

    Could it be that they know they are on a hiding to nothing in having the appeal allowed and are just doing it as a face-saving exercise for us, the great unwashed who have bankrolled the whole shemozzle? (Not that I am a cynic or anything!)

    As gob smacking as it sounds, you have to think that this is the only reason. Someones arrogance (or is that ignorance) is the reason behind the appeal. The thing is, the prime suspect is the victims husband. Which means most of the evidence can easily be dismissed by the defence e.g finger prints, hair, business card at crime scene etc etc. Even if they could prove she was murdered in her own home, I doubt that would be sufficient to get a conviction.

    UPDATE 11.35am: Lloyd Rayney's acquittal stands the former prosecutor and barrister will not have to face a retrial over his wife Corryn Rayney's murder, the Court of Appeal ruled this morning.

    The three appeal judges revealed their decision a short time ago by video link from Melbourne and Sydney.
