    GoFundMe has removed Israel Folau’s fundraising page from its website and is issuing refunds to all his donors, saying the campaign breached its terms of service.

    “Today we will be closing Israel Folau’s campaign and issuing full refunds to all donors. After a routine period of evaluation, we have concluded that this campaign violates our terms of service,” said Nicola Britton, GoFundMe’s Australia Regional Manager.

    “As a company, we are absolutely committed to the fight for equality for LGBTIQ people and fostering an environment of inclusivity. While we welcome GoFundMes engaging in diverse civil debate, we do not tolerate the promotion of discrimination or exclusion.

    “In the days since Mr Folau’s campaign launched, more than one million dollars have been donated to hundreds of other campaigns, large and small, across Australia. Those acts of kindness are the heart of GoFundMe.

    “Our platform exists to help people help others. Australians have shown themselves to be among the most kind and generous people in the world. We look forward to helping more Australians fundraise for causes they care about in the coming months and years.”

    According to the terms and conditions on the website, users may not attempt to raise money “for the legal defence of … intolerance of any kind relating to race, ethnicity, national origin, religious affiliation, sexual orientation, sex, gender or gender identity, or serious disabilities or diseases

    Just a quick thought on freedom of expression/speech and freedom from religious persecution:

    Non-disclosure Agreement (commercial) and Official Secrets Act (government). You sign these, you give up your "rights" to say whatever you like, whenever you like, however you like, on a very specific instance. Nobody, not even Alan Jones or right wing religious nutters, would go in to bat for your "rights" here. BTW Assange has not signed these. "Whistleblowers" might have, but it's not their "rights" at stake, it's a possible notion of "for the public good".

    No different to an employment contract (any contract actually), where you give up your "rights" to certain things - like codes of conduct - for filthy lucre.

    This has NEVER been about freedom of speech or religious persecution. It's about a misguided evangelist, and complete incompetence of the RA in re-signing said evangelist after his first effort. Funnily enough in this largely unjust world, both parties got what they deserved

    Agree up to a point, but would observe there is a very big difference between an NDA, confidentiality agreement, official secrets acknowledgement, etc and the RA Code of Conduct. The first are all very specific in terms of what is being agreed to and the penalties attached, the latter basically says "stuff", applies to everyone (even people over whom they hold no authority) and basically reads like a vision statement rather than a legal document. Seemed to me a more promising line to have taken, but seems it isn't the one being pursued. Or maybe it is, just indirectly - they don't take any action on many of the other things in the code, but do on this, because...?

Back then conciliation conferences could be made compulsory, with orders able to be issued. Under the new regime they are apparently voluntary. In that case the employer (RA) can simply sit pat. They are experts at that.

    I think they should just forget freedom of speech and religious freedom. Just as RWA should have not fought our expulsion on one clause, Folau should just argue on procedural fairness. Yes he breached the code of conduct, but the procedure should have been a hearing then a recommendation then termination of contract. The same as with the Force ARU/RA got it round the wrong way, announced the decision then had the enquiry hearing.

    He was sacked for breaching the code of conduct not for being religious.

    Just like Smith, Warner and Plodcraft were suspended for 9 & 12 months not the for ball tampering but for breaching Cricket Australia's code of conduct.

    Whether RA had their ducks lined up in a row to actually proceed with a sacking, generally people get 3 warnings at a lot of workplaces. Is it deemed a major enough breech of the Code of Condcut will ultimately be tested at the Fair Work Commission. Izzy's statement that he will go to the High Court of Australia is but far fetched. The last sports person who had a victim complex to go through the legal route was James Hird and his application to the High Court was denied.

    Yep, procedural. Including the first briefing last year, and the second contract NOT including any reference to that supposed warning.

    Further, that the punishment does not fit the crime.

    However, both parties are at fault here (not unusual). And the real issue for Izzy is that he has subsequently shown himself to be a complete hypocrite and outright liar. Not a good look for his future when this hullabaloo has died down.
