    Men accused of assaulting former All Black Justin Marshall

    Two men have been charged with assault with intent to injure former All Black Justin Marshall.

    Tai Samuel Neilson, 25, labourer, and Adam David Kearns, 23, both of Christchurch appeared at the Queenstown District Court this afternoon. They are jointly charged with assault with intent to injure Marshall on April 18.

    The case has been adjourned until May 19. Bail conditions included a curfew of 9pm to 6am at their Christchurch home addresses. They were not to consume alcohol or drugs, nor associate with each other or Marshall.

    It's understood the alleged incident happened while Marshall was on a night out.

    Asked whether he would talk about the incident, Marshall said: "No, not at all."

    "There's a court appearance ... and we'll go from there. I've been advised not to say a thing."

    He had hoped to be granted name suppression at the hearing this afternoon but it was declined.

    Kearns was in Queenstown celebrating his birthday at the time.

    On Thursday before the incident, he posted on Facebook: ''The sculling has started 3 beers dowm in a minute, 6 to come over rakaia bridge yaaaaayer!!! 23 years younger lol (sic).''

    On Friday he posted: ''Thanks for all the birthday wishes I think I cut a bit loose..... earnt myself a free nights accommodation and a assault with intent.... Gooooood times".

    Last year Kearns gave evidence against his mother, Helen Milner, who was imprisoned for the poisoning murder of her husband Phillip James Nisbet in April 2009.

    He told the court he found her one night crushing up powder after she had spoken repeatedly of wanting to "get rid" of her husband and talked about ways she could do it.

    Kearns is also suing his mother for $60,000 after she framed him for a crime he never committed.

    He spent 16 days in custody after he was framed but in 2012 Milner was convicted of perverting the course of justice and sentenced to two years and eight months jail.
