    He can claim that it was a security device in the event of a break-in. Just like if I was to go right through my house and put up IP cameras... it would be used for security purposes in the event of a break-in and not to spy on my housemates.

    Yeah that's what I tried to claim when my flatmates had me charged , but apparently putting IP cameras in the toilet bowel doesn't count as a 'security purpose' - pfft whatever

    Nope, he'll have double jeopardy.

    If the prosecutors were smart enough they would have charged him with murder and left the manslaughter charge up their sleeve just incase he was found not guilty. That way he could still be charged with something significant, shoud new evidence be found. He is going to be found guilty for the phone tapping, if the commonwealth trial takes place in WA...

    I think someone has tried to set him up. For a former prosecuter come barrister to leave 'crucial' evidence at the burial site seems a little coincedental! Especially evidence that blatantly leads to him as a suspect. If he had arranged someone to do it for him, you'd think that he would have got some one experienced...

    At the end of the day the police screwed up the case and there is still a killer out there. Perhaps if the police force had some more resources on hand and hadn't focused all there attention on the one suspect then it wouldn't have been such a mess!

    Agree Lonzy! Not the PD's finest moment that's for sure.

    Heard on the radio this morning that the defence engaged Robin Napper - the finest and most expereinced expert in forensics WA has ever seen. With him on the defence side, the bumbling key stone cops stood absolutely no chance of proving the case on forensic evidence.

    Talking of Robin Napper, if you ever get the chance to go to one of his case-study presentations grab it with both hands - captivating and astonishing (if a little gruesome in parts!) He is sometimes on the UWA Extension course programme.

    Do we still have that law in Australia? I know they recently changed the DJ law in the UK to allow people to be tried a second time. I think possibly because of the Stephen Lawrence case?

    Apparently legislation was passed early this year which WA allows a retrial for 'new or compeling DNA evidence' or aquittal due to tainting.

    Other than that double jeopardy still applies
