Hope the above helps, Happy, but be warned, I invariably lose legal arguments.

Never mind, I've heard that Jehna's quite the legal eagle & prepared to take on pro bono (ie charity) cases in order to make a name for herself in the legal circles!!!!!

But Fulv, isn't employment contract law in this specific climate more a case of two lawyers squaring off to see who cares more, rather than any real search for justice or truth?

I'm pretty sure that the Eagles will do whatever it takes to make this go away, if they can successfully fight any action brought against them, they will. If not, they'll throw money at it till it goes away.

So, Fulvio, If I may paraphrase - he who has the most money to spend on Lawyers, WINS.

Since the introduction of the new drug swabbing gig(last weekend) Cousins finds himself the first mug to be charged with refusing a blood test for possible drugs. He was pulled over for erratic driving.....by the organized gang squad.......a small world. Another example of WA Police work, just ask Lloyd Rainey. They couldnt organize the proverbial!

He who has the lawyers who care the most to be properly prepared wins. In this case like GGST says, if he fights hard enough they (the team) will probably settle it just so it goes away.

What type of salary was he making?

his new contract that he signed last year stated that he would have no more run ins with the law.
technically they could have used a speeding fine to get rid of him if they really wanted to.

And it's not like he has strong unfair dismissal laws on his side. He signed the contract, he was getting paid a kings ransom and in the current climate, you can pretty much trade away your right to oxygen for higher wages. That, on top of it being an operating necessity for him not to play for the club, added to the fact that he is no longer licensed to play in the AFL adds up to mean he's gone from the Eagles, and more than likely football altogether.

Should someone give him Sav Rocca's number, he'll fit right in won't he?

The 29-year-old midfielder was charged with possessing a prohibited drug after police pulled him over for driving erratically on Tuesday.
so he still had some drugs that got him arrested and charged.

He got off on a technicality. surely the contract will be written to take this into account. The famous 'Bringing the game into disrepute' clause springs to mind.

An old mentor told me many years ago (bless you Ron Cannon) "they're innocent untill they run out of money".

The more things change the more they stay the same.
