    Prosecutors will appeal Lloyd Rayney acquittal

    PROSECUTORS will appeal the acquittal of prominent Perth barrister Lloyd Rayney, who was found not guilty this month of murdering his estranged wife, Corryn.

    The NSW Director of Public Prosecutions Lloyd Babb directed the appeal today - the deadline for an appeal to be lodged.

    Documents were lodged with the Court of Appeal in WA this afternoon.

    "No further comment will be issued,'' the DPP said.

    A Supreme Court spokeswoman said the draft grounds of the appeal were:

    * The trial judge erred in law in failing to apply the principles enunciated in R v Hillier (2007) 228 CLR 618 in relation to the assessment of circumstantial evidence in that his Honour assessed the circumstances in a piecemeal and sequential manner and failed to consider the circumstances as a whole.

    * The trial judge erred in law in finding that the fact that the deceased was attacked at, or in the near vicinity of her house, did not alone establish guilt, for the nature of the circumstantial case was that no fact alone established guilt.

    * The trial judge erred in law in concluding that the finding of the respondent’s dinner place card near the burial site did not prove guilt for the significance of that fact was not assessed together with the other circumstances, in particular, it was not assessed together with the accepted fact that the deceased had been attacked at or near her home.

    Mr Rayney was acquitted on November 1 following a highly publicised three-month trial and a five-year ordeal to prove his innocence.

    Mrs Rayney, a Supreme Court registrar and mother of two, disappeared after her weekly dance class on August 7, 2007

    jeebus this is has gone to another level of farce. millions more of public funds thrown into the pockets of cringworthy lawyers, and these ones are not even WA but NSW.

    They guy is guilty as sin but this prosecution should have been thrown out of court for lack of making a case. The further it went the worse it got.

    WA prosecution paid for them to come to perth, and stay there. meals allowances and all that shit. cost more than it would have if they were from WA.

    i doubt the result will change anyway
    and if it does. he will appeal his conviction. should have just let it go

    How would a Supreme Court spokesperson know the "draft" grounds of appeal? If they are in "draft" form they would not yet be lodged. I call bullshit on that.

    And if those were the grounds of appeal, any lawyer would bat them away more easily than Clarke against the South African bowling attack - yes even me.

    This is, at best, either very sloppy reporting , or, at worst, somebody making shit up.
