Shell company is the same as a limited company in the U.K.

There's a Wikipedia article about it.

I think a shelf company is unused and empty, waiting. A shell company is pretend, intended to deceive

Don't know how it works in Australia an unused company is declared dormant company and you have to apply to start using it again for trading.

A company can sit dormant and be wound up. This is not just to stop for company tax, prevent fraud is the main reason.

Not sure if there is a Gazette equivalent in Australia that keeps a public record of when companies have been liquidated, gone to court, wound up, set up, etc.

There is certainly some sort of public register. ASIC maintains it.

Just had a read of the ASIC enforcement outcomes for Jan - Jun 2017 and one of the areas of interest is: Holding gate keepers to account. They state that Company directors and senior executives and officers are important gatekeepers who hold positions of responsibility and trust, and who are required to lawfully discharge the obligations that these positions carry.
In the recent AWB case, ASIC found that Trevor Flugge, the former AWB Chairman had contravened s 180(1) of the Corporations Act and had breached his duties as a director of AWB by failing to make adequate inquiries about the propriety of payments made to ...(the Gov of Iraq while the country was subject to UN sanctions) ...this is the sliding doors moment that allows for time travel ...the Chairman of RA has contravened s 180(1) of the Corporations Act and breached his duties as a director by failing to make adequate inquiries about the bona fidability of the purchaser of the Rebels and paid him millions of dollars of Union money without any performance hurdles such that it brought the national body to the point of bankruptcy and it subsequently closed one fifth of its professional base ...

That’s why we need to keep the pressure on ASIC, and keeping what the RA have done in the spotlight. They’re desperately trying to brush everything under the carpet & pretend it’s business as usual, but they can’t hide the glaringly obvious! I do notice that yesterday there seems a lot more people speaking out about the corruption of Clyne & Pulver & co.

    Nice work Lou!

I emailed Senator Reynolds’ Chief of Staff yesterday to ask him if he is able to provide an update on how the implementation of the Senate inquiry recommendations is tracking. Waiting for him to get back to me.

That would be a great outcome. I recall reading that contempt charges are rarely punished, even though the remedies extend right up to prison sentence. But just to have them found in contempt should be enough to see Clyne gone. So I hope it goes ahead when/IF ASIC. The most astonishing thing about the hearing stages, for me anyway, was Clyne's opening piece at the inquiry. He began by lecturing the senators for their temerity in calling Rat's Arse to testify, that they were wasting taxpayers funds and basically didn't understand how directors work nor what a busy and important person he is. I was really amazed at how contemptuous and delusional he was.

Actually they might go hard on de Clyne as he has received his parliamentary privileges twice, lied on both occasions and has been accused of trying to stop the Inquiry.

Tim North should get a wrap for dialling in late to reduce his testimony time and filibustering during his opening statement. He also displayed a poor attitude to the Senators.

In my email I did ask about that as well.

Hopefully we get some news soon as there has been a total dearth of information of any kind of late. Nothing from the Senate, ASIC, Minderoo or RugbyWA since the beginning of December. I for one am keen to know what's going on as I want to start doing something to help!!
