ARU lifts Super Rugby contract moratorium; will honour existing deals

The Australian Rugby Union (ARU) has lifted its moratorium on Super Rugby player contracts and promised to honour deals for those who sign with a team which is subsequently axed.

ARU chairman Cameron Clyne also refused to rule out the possibility that all five Australian Super Rugby teams could remain next season amid legal threats associated with plans to cut either the Melbourne Rebels or Western Force.

"We obviously recognise that we'll have to honour those (player) contracts, and that's what we intend to do," said Clyne, as he announced the contract moratorium was being lifted on Monday.

The issues surrounding the long-running Super Rugby team axing saga are set to be thrashed out behind closed doors at an extraordinary general meeting of the ARU on June 20.

The ARU has locked in the date for the meeting, which will be held in Sydney three days after the Wallabies' Test against Scotland at Allianz Stadium, and four days before they face Italy at Brisbane's Suncorp Stadium.

The meeting was called by the Victorian Rugby Union and the Rugby Union Players' Association, both seeking answers on how the ARU intends to proceed with its previously declared intent to cut one of the five Australian franchises from Super Rugby.

RUPA said two weeks ago they wanted a "comprehensive update" on the matter at an EGM as well as the chance for voting members to "collectively determine" the best course of action for Australian rugby going forward.

While it's believed there is no immediate threat to the ARU board, there is the capacity for a leadership challenge - by way of a vote of no confidence - to be staged if those in the meeting are not satisfied with what they hear.

However, ARU chairman Cameron Clyne was re-elected only last month at the governing body's annual general meeting on April 10 - the same day it was announced either the Melbourne Rebels or Western Force would be the team to be shut down.

Despite an initial timeframe given by the ARU of within two to three days, there is still no sign of a resolution on to which team will go amid legal threats from Rebels owner Andrew Cox and Rugby WA, and the added threat of funding withdrawal by the respective state governments.

What a joke so the two reason they state with dropping a team will not be realised next year one at least fully.

Costs some 30 odd players will be paid out for not playing.

Talent will still be spread out across the country. Not condensed like they wanted.

The Force need to sign Adam Coleman and soon nothing against any of the other players it's just that Adam represents the player all other franchises want and therefor gives the most media attention and air play if he signed with the Force.

Interesting first time he has not categorically stated that it is four teams whether we like it or not.

    Interesting you mention that.

A player could sign a 10 year deal and then be paid out if their team is culled. You would have thought the ARU who are responsible for the registering of the contracts would have rules in place, but the ARU are proving to be pretty much making it up as they go.

I am not sure if this Clyne is for real, he is blaming the slow process on every kind of roadblock having been thrown in the ARU's way.

Did he really think someone and in particular us was going to take one for the team.......

I am stunned, an educated man that headed up NAB....

PS And yet to acknowledge the mental anguish he and his team have and are causing to the players, families, friends, associated staff, fans, sponsors, members, and general public that care about the game we all love or at least still trying to.

I know it's not complete but the Rebels have 8 of 25 on that list off contract. We have 17 of 34. Given that the ARU need to OK the contracts, and had control of ours, it's not too difficult to see which franchise were in their sights all along. Clark was telling the truth to MRRU to his best knowledge at the time, I'd guess.

    This ^^^^^

More proof in pudding. All the FUBARU tossers were waiting for after insisting on the license as collateral rather than a bail out LIKE THE OTHER NINE was the year necessary to rebrand the competition to 15 teams.

Anyone else think the moratorium has been lifted just so the Tahs (and Reds) can start sniffing around our and the Rebels' best players in earnest and offer them all sorts of riches we have no hope of being able to match? It's all such a crock of BS.

And Tazz is right about Clyne - don't know what planet he's living on but it's not the same one as me! And whatever business qualifications he has obviously came free inside a box of Wheetbix.

If Force management are as smart as they've proven to be so far, they will have contracts all ready to be signed and ratified. To keep as many professional players as they have coming off contract from signing European contracts at the death knell (such as it is) surely indicates that they have something ready to go (otherwise there would have been lots of boys signing overseas contracts)

Expect to see Dane sign with the Force in days, Adam has been available to sign all along as he is a Wallaby.

for any player who isn't the core of Aussie rugby, it makes a lot of sense to sign a three year contract tomorrow, since they have secured their future (or at the very least a massive cash payout and the ability to negotiate with an overseas team)

Hansie, Blood, recruiting team, take note. get the signatures tomorrow and send the paperwork into the ARU.

It seems to me that the ARU have tried to play bully boys (yet again) to intimidate/rattle the Force team, make them panic and cause undue stress to make them do a runner. By holding firm with the knowledge the ARU are toothless, they can call their bluff.

Stretching memory here although Adam is a Wallaby and will be again after the announcement today he doesn't have the required number of games to get the wallabies top up. Just thinkin back to Ben and Honey Badger when they were going through negotiations. Wasn't there a minimum amount of caps and service length to get the top up unless of course you are a ARU sponsored League AFL convert.

Also would love to see all of those WA boys come out in a bulk signing announcement out the front of NIB arms cross jerseys on. Can see the photo now. Of course to continue the impetus that would need to be soon. And if the ARU is stuffing around with contracts then and intent to sign from those boys with the same photo would serve better.

HOST of Western Force stars led by Wallaby Adam Coleman are set to sign with rival franchises now the ARU’s contract moratorium has been lifted, further dimishing the Perth club’s prospects of survival.
Coleman is expected to be one of several Force players to sign with Melbourne Rebels, the other side named by the ARU as being in the firing line as Super Rugby redacts from 18 to 15 teams next year.
While the ARU has been left hamstrung by legal action and threats from both clubs, their move on Monday to lift the contract freeze is expected to hasten the Force’s demise.
Rebels owner Andrew Cox has said he will not sell the license of the club, leaving the Force as the club to be dumped.
Players at the club read the tea leaves weeks ago and have been secretly negotiating deals with rival clubs, waiting for the moratorium to be lifted.

Up to six Force players are understood to have agreed to terms with rival clubs.
Clyne would not explain how the ARU could remove the Rebels from Super Rugby if Cox would not give up the license.
“I’m not going to comment on specifics, just to say we’re maintaining a dialogue with both teams,” Clyne said.
WA Rugby has imposed a legal injunction upon the ARU citing elements of a contract signed by both parties when the national body took over the running of the franchise late last year that guaranteed their survival until 2020.

Clyne said he does not expect any legal payouts to be more than the money the ARU would save from axing a team.
Lifting the contracting freeze could decimate the Force’s roster, and by the time the ARU stages an extraordinary general meeting on June 20 in Sydney several of their top names could be signed to rival teams.

Players who sign for a team or on multi-year deals with a team that is then cut will be relocated to other clubs, given the option of an early release or have their contracts paid out.
“If we do end up in a situation where there are less teams than there are, then we’ll down and it will be a player by player basis,” Clyne said.
“We’re saying to players we’ll give you the certainty of honouring your contract or pursuing an early release or whatever you happen to want.
“In some cases players may be happy to move to another franchise.”
Clyne added that players understood the pressures that have forced the ARU to make the decision to cut one team.
“There has been concern expressed to us in the past from players around insolvency of the franchise they play for, so they’re aware of the issues,” Clyne said.
“They do understand this issue of financial sustainability.
“Our intention is to go down a path working towards four teams.”

Clyne said South African Rugby Union had indicated they would also meet their end of the bargain by cutting two teams.
“Certainly from their indications, they are still committed to their announcement of going down from six teams to four,” he said.
Talks are already underway with 13 broadcast partners about how the 15-team tournament will run next year.
“There has been a long-term trend over the last couple of years of declines in crowds,” Clyne said.
“That has continued this year, that’s not about uncertainty, that is the continuation of a long-term trend.
“Given the teams that are under threat ... they’ve not had the crowds there either.
“I know there’s a lot of emotion and passion around this, but we’ve got to strip that back and say the game is struggling.”
