    Businesses with 15 staff or less can let you go. They don't necessarily comply with unfair dismissal rules if they are offering severance pay.If you are being offered a redundancy payout, then they are being very generous. Unfortunately, this is a sign of the times. Most small businesses are a week ahead of insolvency. Superannuation is going to 12% over the next few years. Most small businesses are behind on their GST obligations. Unemployment will be heading north pretty fast. Businesses are going to the wall. They can't afford staff. It is too costly to employ people. Workers comp, sick pay that accumulates annually, rising super, holiday pay. Most businesses aren't profitable enough to pay all the staff entitlements. Sorry if Fulvio don't bleedin like it but Aussies are on the gravy train and business is struggling to afford staff. That's why all the corporates are pulling out and manufacturing is unviable in Australia. If you don't believe me, try starting a business and see if you can afford to pay anybody.

    Yes you're right. If you ignore the fact that Super increases have been frozen for the next 7 years, providing that committment will honoured.

    100 percent on the money Rex. As the owner of a small business involved in the construction sector everything you posted is correct.
    After paying my staff all their entitlements you mentioned and more with training levies etc they were doing better than me so I laid them all off.
    Little wonder CFMEU membership is down 60 percent and 457 visa's seem to be all the rage.

    Easy way to fix the problem is get al his employees to leave then watch the bugger try and run his small business... I had a mate have the same problem many yrs ago and the got all the 7 other staff to quit... and they started their own business up in opposition.. Took all the customers with them Sent the guy to the wall legally...

    Get a new job and save yourself the pain of going through a lengthy drawn out process which is heavily stacked in the employers favour. Ive tried going to various employee advocates in the past and it got me no where. My advice is just move on.
